Unprecedented Legal Move: Ukrainian Torture Case Lands in Argentina


A Ukrainian man’s harrowing ordeal allegedly at the hands of Russian occupying forces has prompted an unprecedented legal move halfway across the globe to Argentina.

This unprecedented step aims to hold perpetrators accountable for purported war crimes, amid overwhelmed prosecutors in Kyiv.

In a recently disclosed filing reported by Reuters, the man, whose identity remains shielded due to concerns for his family’s safety in Russian-occupied regions of Ukraine, accuses specific individuals, identified by names or military insignia, of subjecting him to electrocution and unlawful imprisonment during the tumultuous period of mid to late 2022.

The filed complaint, examined by Reuters, details the agonising experience endured by the victim, including the use of electric shocks that led to loss of consciousness, narrated by the victim himself from a discreet location in Buenos Aires.

The legal submission, spanning nearly 70 pages, presented by the man’s legal team alongside members of the Ukraine-based NGO The Reckoning Project, contains testimonies from fellow detainees corroborating the allegations.

Additionally, it references UN experts’ findings highlighting similar patterns of torture at various detention sites.

The victim recounts being interrogated and tortured over approximately three weeks before being released without charge, subsequently finding refuge in a non-occupied territory within Ukraine.

Crucially, the complaint refrains from divulging specifics that could jeopardise the victim’s security or the integrity of the proceedings.

The Argentine court now faces the weighty decision of whether to accept the complaint, a process likely to extend over several months and kept confidential until a verdict is reached.

If Argentine prosecutors opt to proceed with the case, it would mark the first instance of addressing alleged Russian war crimes in Ukraine outside of Europe and the United States.

Yuriy Belousov, head of Ukraine’s war crimes unit, underscores the significance of leveraging universal jurisdiction in light of the staggering volume of war crimes cases flooding the country’s justice system since Russia’s invasion in February 2022.

Argentina’s historical commitment to universal jurisdiction, forged through landmark trials of former military dictators, positions it as a guiding principle for worldwide justice.

This principle empowers prosecutors to pursue cases of war crimes and crimes against humanity irrespective of territorial or national affiliations of victims and perpetrators.

The move to file this case in Argentina serves not only as a quest for individual justice but also as a potent signal to would-be perpetrators that accountability knows no borders.

Last year’s damning U.N. report on Russia’s widespread use of torture underscores the urgency of such legal actions.
